SCHOLARSHIP PROGRAM DESCRIPTION: We are inspired every day by the beautiful discoveries you share with us. To honor the vibrancy and value that each of you bring to Trover, we created the Trover Travel Scholarship Program (“Scholarship Program”). Each month, we will award a scholarship to one traveler who has particularly inspired us with their photos and stories. The participant who is selected as the Scholarship Program Recipient (“Recipient”) for the month will receive a $500 award, (a travel voucher or cash, depending upon the country of residence of the Recipient) awarded to particularly good members of the Trover community that we want to highlight as users providing high quality content and value to the community. Scholarship recipients are selected by Trover staff.
ELIGIBILTY: The Scholarship Program is open to users who are at least 18 years of age or older and have an account with www.trover.com (the “Website”). Accounts can be created for free on the Website or via the iOS App or Android App. Void where prohibited or restricted by law. Officers, directors and employees of Trover (“Promoter”), Expedia, Inc. (“Expedia”), and each of their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouses, parents, children and siblings, and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to submit a Catalog Submission (as defined below). The Scholarship Program is subject to all applicable federal, state and local laws. Promoter’s decisions are final and binding on all matters relating to this Scholarship Program.

CATALOG SUBMISSION GUIDELINES and CONTENT RESTRICTIONS: Your Catalog must comply with the Terms of Service of the Website and these Scholarship Program Terms. Promoter reserves the right to delete or disregard Catalogs that are inappropriate or that do not comply with the foregoing: (i) is original to him/her; (ii) does not violate any law, statute, ordinance or regulation; (iii) the Catalog must not contain material that violates or infringes another person’s rights, including but not limited to privacy, publicity or intellectual property rights, or infringe on any rights and/or interests of any third party; (iv) the Catalog must not contain material that is hateful, tortious, defamatory, slanderous or libelous toward any person living or deceased, or otherwise infringe upon any person’s personal or proprietary rights; (v) the Catalog must not contain material that is obscene, sexually explicit or pornographic or promote bigotry, racism, hatred or harm against any group or individual or promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or that is designed to annoy or harass; (vi) Photos in the Catalog must not make any references to alcoholic beverages, tobacco, drug paraphernalia, firearms, or any depiction or representation thereof; (vii) the uploaded Catalog submission must not contain any virus, Trojans, hacks, spyware or malicious code of any type; (viii) the Catalog must be suitable for audiences of all ages and be consistent with Promoter’s reputation in the marketplace, including its reputation for quality and integrity; and (ix) the uploaded Catalog submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where a photo is created.
Failure of any photo in a Catalog to comply with the above Catalog Submission Guidelines and Content Restrictions, as determined by Promoter in its sole discretion, may result in the deletion of the Catalog and disqualification from the Scholarship Program. No Catalog will be returned. Promoter shall have the right to delete, edit, adapt and publish any or all of the photos and/or Catalogs, and may use them in any media without attribution or compensation to the User, his/her successors or assigns, or any other entity. As more fully explained below, SUBMITTING A CATALOG IN THIS SCHOLARSHIP PROGRAM CONSTITUTES A GRANT OF AN IRREVOCABLE, ROYALTY-FREE WORLDWIDE LICENSE TO PROMOTER AND ITS AFFILIATES TO REPRODUCE AND DISPLAY THE UPLOADED PHOTO AND/OR CATALOG, OR ANY DERIVATIVE THEREOF, IN ALL MEDIA NOW KNOWN OR HEREAFTER DEVISED, INCLUDING, WITHOUT LIMITATION, THE INTERNET, IN PERPETUITY. Promoter is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Catalogs. Such Catalogs are void and will be disqualified. Promoter is not responsible for inability to connect to any website including but not limited to the Website. Promoter is not responsible for inability to upload the Catalog. Promoter, in its sole discretion, may feature any submission submitted in this Scholarship Program at any time during, or after, the Submission Period on any related websites, in any promotional materials, whether related or unrelated to the Scholarship Program, and at any other location, whether physical or online, that Promoter, in its sole discretion, deems appropriate for the operation and promotion of this Scholarship Program.
SELECTION OF RECIPIENTS: User catalogs will be reviewed on a monthly basis (“Catalog Submission Period”). Only Catalogs received during the Catalog Submission Period and which are otherwise fully compliant with these Scholarship Program Terms are “Valid Catalog Submissions.” Catalogs will be reviewed and a Recipient will be selected from all Valid Catalog Submissions on the 25th of the month (or the next business day if the 25th is a Saturday, Sunday or legal holiday). Catalog Submissions received after the 25th of each month will be eligible for the following month’s award. Recipients will be announced on Trover.com on the first of each month (or the next business day if the 1st is either a Saturday, Sunday or legal holiday).
Users may participate using only one (1) email address throughout the Catalog Submission Period. In the event of a dispute involving Catalog Submissions submitted by multiple individuals using the same email account or address, the Catalog Submission will be deemed to have been submitted by the authorized subscriber of the email account used to enter the Scholarship Program at the time of Catalog Submission. The authorized account holder is defined as the natural person who is assigned to an email address by the relevant Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address. If the Catalog Submission is created under a joint account, only one (1) scholarship will be awarded to the joint account.
All eligible Catalog Submissions received by the Promoter will be considered and reviewed based on a variety of factors including without limitation, written description of what is interesting about the photo, images that are consistently, accurately geotagged, have a primary focal point in crisp focus without the overall picture being blurry or grainy, personality, experience, and other factors determined by Promoter in its sole discretion to determine one Recipient each month, provided they are eligible and compliant with these Scholarship Program Terms.
NOTIFICATION OF FINALISTS: Potential Recipient will be notified by email using the information provided in their Account on or about the 25th of each month (or the next business day if the 25th is either a Saturday, Sunday or legal holiday). Potential Recipient will be required to sign an affidavit of eligibility and publicity/liability release, and any other documents required by Promoter within 5 days of initial notification, or an alternate may be selected. If any potential Recipient is found to be ineligible for any reason, an alternate may be selected. If notification is returned as undeliverable, it will result in disqualification, and an alternate Recipient may be notified. Any non-response by a potential Recipient, or Promoter’s failure to receive a response from any potential Recipient within the prescribed 5 day notification period will result in disqualification and the selection of an alternate Recipient. In the event of any non-compliance with these Scholarship Program Terms, the potential Recipient will be disqualified and an alternate Recipient will be selected. Promoter is not responsible for unsuccessful efforts to notify any potential Recipient.
AWARD DETAILS: One (1) recipient will receive a travel voucher for $500 off any booking for a package or stand-alone hotel on Expedia.com. The travel voucher expires one year from the date of issue and can only be used on one (1) booking. If Recipient is from a country where Expedia does not have a point of sale, the award will be $500USD cash, converted to local currency. Re-bookings are not allowed. The value of the booking is not refundable. Booking is subject to certain terms and conditions as specified by Expedia (see award Terms and Conditions for details for the voucher terms). Certain blackout dates and travel restrictions may apply.
A Recipient is responsible for paying any applicable income taxes and any expenses not listed above. Any award details not specified above will be determined by Promoter in its sole discretion. An award may not be transferred and must be accepted as awarded. Promoter reserves the right to substitute an award with another prize of equal or greater value if the prize is not available for any reason.
To the extent the Recipient posts or publishes reviews of any of the award, the Recipient must comply with the FTC’s endorsement guidelines: “Guides Concerning the Use of Endorsements and Testimonials in Advertising: Notice Announcing Adoption of Revised Guides”, which can be found here: http://ftc.gov/os/2009/10/091005revisedendorsementguides.pdf and at http://www.ftc.gov/opa/2013/03/dotcom.shtm.
For any travel booked using the award, the Recipient and his/her guest(s) are responsible for obtaining any required necessary documentation (i.e., valid passport, visas, etc.) prior to travel. The Recipient is responsible for paying any applicable federal, provincial, state, local, income and withholding taxes, if any, and any and all other costs and expenses not listed herein as being provided, including but not limited to ground transportation, luggage fees, meals, hotel incidentals, souvenirs and gratuities. In the event that any tax withholding is required by law for an award, the Recipient authorizes Promoter to make the corresponding deduction. The Recipient may not transfer, assign or substitute the award, or redeem the award for cash (unless award is made in cash), except at the sole discretion of the Promoter, who reserves the right to substitute the award (or portion thereof) with one of comparable or greater value. The award is awarded “as is” without any warranty or guarantee, either express or implied by Promoter.
GENERAL: By participating, all participants warrant and represent that they have complied in full with these Scholarship Program Terms, including but not limited to all eligibility requirements, and further agree to be bound by these Scholarship Program Terms and the decisions of Promoter and/or the judging organization or entity, which are final and binding in all respects. Photocopies, facsimiles, incomplete or mechanically reproduced Catalog Submissions are not eligible. Catalog Submission materials that have been tampered with or altered, or mass Catalog Submissions or Catalog Submissions generated automatically or robotically, or by a script, macro or use of any automated device(s) are void. Neither Promoter nor its parents, affiliates, subsidiaries, divisions and/or advertising or promotion agencies are responsible for: (i) lost, late, misdirected, or damaged Catalog Submissions; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of Catalog Submission materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive Catalog Submission information by Promoter; (iii) hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the website in whole or in part for any reason; traffic congestion on the Internet or the website; unauthorized human or non-human intervention of the operation of the Scholarship Program, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Scholarship Program, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Scholarship Program; or (iv) any injury or damage to participant’s or any other person’s computer related to or resulting from entering or otherwise participating in the Scholarship Program. Promoter reserves the right to withdraw and terminate, or modify, the online method of Catalog Submission if it becomes technically corrupted, if a computer virus or system malfunction impairs its ability to conduct the Scholarship Program, or if the online Catalog Submission method otherwise becomes impossible, impractical, infeasible for any other reason. If for any reason the Scholarship Program is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Scholarship Program, Promoter reserves the right, at its sole discretion to cancel, modify or terminate the Scholarship Program. Promoter also reserves the right to terminate the selected Recipient and/or the Recipient position at any time and may replace the applicable Recipient or the Recipient position with an alternate participant of Promoter’s choice.
WARRANTY: By submitting a Catalog, each Participant warrants and represents (i) that the participant owns all rights to the Catalog Submission he/she is entering in this Scholarship Program, including, without limitation, the photo, with the exception of any Promoter brand assets provided or made available by the Promoter for use by participants in connection with this Scholarship Program; (ii) that the participant has obtained permission from each and every person appearing in the Catalog Submission (if any), granting full exhibition rights to the Promoter as described in these Scholarship Program Terms, and can make written copies of such permissions available to the Promoter upon request; (iii) and that his/her Catalog Submission: (a) is original to the participant and has been legally obtained and created, (b) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws, rules regulations, or network standards; and (c) has not won any previous Trover scholarships or awards within the past twelve months.
PROMOTER’S RIGHTS TO ENTRIES: By participating, you: (a) irrevocably grant Promoter, its agents, licensees, and assigns the unconditional and perpetual (non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Catalog Submission and related photo(s) as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude Promoter’s use of your Catalog Submission, or require any further permission for Promoter to use the Catalog Submission; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Promoter on the grounds that any use of the photos in your Catalog Submission, or any derivative works, infringes any of your rights as creator of the Submission, including, without limitation, copyrights, trademark rights, and moral rights.
By participating in the Scholarship Program, each participant agrees to release, defend, indemnify and hold harmless Promoter and its subsidiaries, affiliates, advertising agencies, promotion agencies, franchises, fulfillment companies, dealers, retailers, present and former officers, directors, employees, directors, and agents from and against any and all claims, demands, expenses, losses and liabilities of any nature whatsoever caused or contributed to by entering or participating in the Scholarship Program, the acceptance, use or misuse of any award, participation in any award-related activities, including any claims of third parties claiming infringement of trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation, and further agrees to release and indemnify and hold harmless Promoter from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Promoter infringes on the rights of participant’s work as contained in any submitted Catalog Submission.
By submitting a Catalog Submission, Participant recognizes and acknowledges that the intellectual property, including, but not limited to: trademarks, service marks, domain names, names, titles, symbols, logos, designs, artwork, phrases, trade names and trade dress, and any combination thereof associated with Promoter and/or any of its affiliates, whether registered, pending registration, or subsisting at common law and the goodwill associated therewith are the sole and exclusive property of Promoter and/or its affiliates. No rights are granted hereunder to Participant for any use other than that specified in the Catalog Submission process. Participant agrees that all ownership rights in the intellectual property of the Promoter and/or its affiliates will remain with such parties and participant will not claim any right, title, or interest in and to, or attack the title or any rights of such intellectual property, except for the right to use such intellectual property in accordance with the Catalog Submission process.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE THIS WEBSITE OR INTERFERE WITH THE OPERATION OF THE SCHOLARSHIP PROGRAM, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND PROMOTER RESERVES THE RIGHT TO SEEK AND TO DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Disputes: All Promoter’s decisions in relation to the Scholarship Program are final and Promoter will not enter into any correspondence with entrants other than the recipient. Except where prohibited by law, Users agree that any and all disputes, claims and causes of action arising out of, or connected with, the Scholarship Program or the award awarded shall be resolved individually, without resort to any form of class action. This Scholarship Program is subject to all applicable federal, state, and local laws and regulations. The laws of the State of Washington govern this Scholarship Program without reference to choice of law principles. Any dispute regarding the Scholarship Program is exclusively subject to the courts of the State of Washington. You hereby irrevocably waive any and all right to a trial by jury in any legal proceeding arising out of or relating to the Scholarship Program. You further waive any objection to venue in the State of Washington, whether such objection is based on lack of personal jurisdiction, improper venue, forum non conveniens, or the like.
